The defendant, Kenneth M. Seaton, Jr., was convicted by a jury in the Sevier County Circuit Court of driving while under the influence of an intoxicant (DUI) and received a sentence of eleven months, twenty-nine days in jail, of which all but forty-eight hours was suspended, and a fine of two hundred, fifty dollars. Both the defendant and the state have appealed as of right. The defendant contends that the trial court erred in holding that the police were justified in stopping the defendants car, while the state contends that the trial court "abused its discretion by sentencing the defendant to the minimum sentence for a first conviction for DUI."
